How to Find the Right Court for Your Traffic Ticket
Every California traffic ticket is handled by the Superior Court in the county where you received the citation β not where you live. If you received a ticket in Orange County but live in Los Angeles County, you must file your Trial by Written Declaration with the Orange County Superior Court.
Why the Correct Court Address Matters
Filing with the wrong court or sending documents to the wrong address can void your contest entirely. Many California courts have separate mailing addresses for their traffic divisions, and some require specific form types or cover letters. Sending your Trial by Written Declaration to the main courthouse address instead of the traffic division can cause delays or rejection.
What Is a Trial by Written Declaration?
Under California Vehicle Code Β§40902, every driver has the right to contest a traffic ticket by mail instead of appearing in court. You submit a written statement (your declaration) explaining why the ticket should be dismissed, along with any supporting evidence. The citing officer also submits a declaration, and a judge or commissioner decides the case based on both written statements.
Form Requirements by Court
Most California courts accept the standard Judicial Council form TR-205 for Trial by Written Declaration. However, some courts require their own local forms or additional documents like cover letters.
